Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt HMY Airways 250 – 3600 Lysander Lane, Richmond BC, V7B 1C3 subject to the conditions of this exemption, from the requirements of paragraph 705.124(1)(b) and clause 705.124(2)(b)(iv)(B) of the Canadian Aviation Regulations (CARs) and from the requirements of paragraphs 7.3.1(a), of the Initial Part Seven and paragraph 7.1.1(a) of the Annual Part Seven of the Flight Attendant Training Standard (FATS) – (TP12296 E) made pursuant to paragraph 705.124(1)(b) of the CARs.
Paragraph 705.124 (1)(b) of the CARs states that every air operator shall establish and maintain a training program that is approved by the Minister in accordance with the Commercial Air Service Standards and, in respect of flight attendants, in accordance with the Commercial Air Service Standards and the FATS.
Clause 705.124(2)(b)(iv)(B) stipulates that an air operator's training program shall include, in respect of flight attendants, initial and annual training, including aircraft type training.
Paragraph 7.3.1(a) of the Initial Part Seven and paragraph 7.1.1(a) of the Annual Part Seven of the FATS states that each drill shall be performed using the appropriate aircraft or approved training device.
PURPOSE
The purpose of this exemption is to allow HMY Airways to use a B767 over wing exit simulator as an equivalent means to operating a B757 over wing exit for Aircraft Exit Operation Drills as required by paragraph 7.3.1 of the FATS Initial Part Seven and paragraph 7.1.1 of the FATS Annual Part Seven. The Schedule A of the FATS– Aircraft Exit Compatibility Groups – does not recognize the B757 over wing exit or an alternative.
APPLICATION
This exemption is applicable to HMY Airways, 250 – 3600 Lysander Lane, Richmond BC, V7B 1C3, only when conducting the HMY Airways' initial and annual flight attendant training program pertaining to the aircraft over wing exit operation drill.
CONDITIONS
This exemption is subject to the following conditions:
- HMY Airways Initial and Annual Flight Attendant Training Programs shall include and emphasize the differences between the B767 over wing exit and B757 over wing exit;
- HMY Airways shall use this exemption only and for the sole purpose of conducting HMY Airways' initial and annual flight attendant training programs pertaining to the over wing exit operation drill;
- HMY Airways shall clearly identify in each flight attendant's record that a B767 over wing exit simulator was used as an equivalent means to operating a B757 over wing exit for aircraft operation drills;
- HMY Airways shall ensure that the B767 over wing exit simulator is approved in accordance with the CARs; and
- HMY Airways shall ensure that each flight attendant attending the initial and annual training programs meet all of the other applicable requirements as set in the CARs, the Commercial Air Service Standard and in the FATS.
VALIDITY
This exemption is in effect commencing October 14, 2005 at 23:59 EDT and until the earliest of:
- April 15, 2007 at 23 :59 EDT;
- the date on which the exemption is superseded by an amendment to the Canadian Aviation Regulations or its associated standards;
- the date on which any of the conditions set out in this exemption is breached; or
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
